What is bullying & harassment?
Harassment and bullying may seem interchangeable, but in fact they are quite distinct in law. As defined by Acas:
- Harassment: is "unwanted conduct affecting the dignity of men and women in the workplace. It may be related to age, sex, race, disability, religion, sexual orientation, nationality or any personal characteristic of the individual, and may be persistent or an isolated incident. The key is that the actions or comments are viewed as demeaning and unacceptable to the recipient”. It is unlawful.
- Bullying: "may be characterised as offensive, intimidating, malicious or insulting behaviour, an abuse or misuse of power through means intended to undermine, humiliate, denigrate or injure the recipient”. It does not relate to the recipient’s characteristics and is not covered by legislation. Employees are best covered if their employer has a B&H policy where this behaviour is outlined as unacceptable in the workplace

- Because it costs: The Health and Safety Executive (HSE) estimates bullying accounts for up to 50% of stress-related workplace illnesses, which means every year, bullying costs UK employers 80 million lost working days and up to £2billion in lost revenue
- Because it makes business sense: A workplace environment and organisational culture free from hostility is more innovative, essential in today’s competitive marketplace
- Because it’s good for the brand: An organisation’s image (to employees and customers) is better when not being harmed with incidents of bullying and harassment reaching tribunal level and attracting media attention
